Welcome to CALL A PCP (“CALL A PCP,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of www.callapcp.com (the “Website”) and related online services made available by CALL A PCP.
Certain healthcare services may also involve use of a separate patient portal, electronic health record system, telemedicine platform, laboratory service, pharmacy, payment processor, or other third-party service.
By accessing or using the Website, you acknowledge that you have read, understood, and agree to these Terms. Clinical services are additionally subject to applicable patient agreements and policies, including our Telemedicine Informed Consent, Consent to Treat, Financial Policy, Notice of Privacy Practices, and other applicable clinical forms or acknowledgments.
If you do not agree to these Terms, you should discontinue use of the Website.
1. Medical Emergency Notice
CALL A PCP does not provide emergency medical services through this Website or its routine telemedicine services.
If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency department.
Examples of medical emergencies may include:
Chest pain
Severe difficulty breathing
Signs or symptoms of stroke
Severe bleeding
Loss of consciousness
Seizures
Severe allergic reactions
Suicidal thoughts, intent to harm yourself or others, or other psychiatric emergencies
Do not use the Website, patient portal, email, text messaging, or routine telemedicine services for emergency medical needs.
2. Description of Services
CALL A PCP is a California-based telemedicine medical practice providing healthcare services through licensed healthcare professionals.
Services may include, when medically appropriate:
Primary care consultations
Evaluation of appropriate non-emergency medical concerns
Medication management
Prescription refill evaluations
Weight management consultations
Hormone health consultations
Laboratory testing requests and review
Preventive healthcare counseling
Follow-up medical care
Other services offered by CALL A PCP from time to time
The availability and scope of services may change.
Telemedicine is not appropriate for every medical condition. Your healthcare provider may determine that you require:
an in-person examination;
laboratory or diagnostic testing;
imaging;
referral to another healthcare professional;
specialist evaluation; or
emergency medical care.
No particular test, prescription, treatment, referral, or medical outcome is guaranteed.
3. Telemedicine Services and Consent
Telemedicine services may involve the use of electronic communications, including video, audio, secure messaging, electronic transmission of medical information, or other technologies permitted by applicable law.
Before receiving telemedicine medical care, patients will be provided with and asked to complete or acknowledge the applicable Telemedicine Informed Consent.
The Telemedicine Informed Consent governs the risks, benefits, alternatives, and limitations associated with telemedicine.
These Terms of Use do not replace the Telemedicine Informed Consent.
4. Physician-Patient Relationship
Accessing this Website, reviewing its content, submitting a general inquiry, creating an account, or requesting or scheduling an appointment does not by itself establish a physician-patient relationship.
A physician-patient relationship may be established only when an authorized CALL A PCP healthcare provider accepts the patient for care and the requirements applicable to the particular clinical service have been satisfied.
This may include:
verification of the patient's identity;
confirmation of the patient's physical location;
collection of appropriate medical information;
completion of required consents and acknowledgments; and
acceptance of the patient for evaluation or treatment by a licensed healthcare provider.
Nothing on the public Website constitutes individualized medical advice.
5. Eligibility and Geographic Limitations
CALL A PCP currently provides telemedicine clinical services to eligible patients who are physically located in California at the time healthcare services are provided, unless CALL A PCP expressly indicates otherwise.
Patients must generally be 18 years of age or older unless CALL A PCP specifically offers and agrees to provide services to a minor in accordance with applicable law.
You agree to provide accurate and complete information regarding your identity, age, location, medical history, and other information reasonably required to provide care.
CALL A PCP may decline, postpone, or discontinue services when medically, operationally, or legally appropriate.
6. Accuracy of Medical Information
You are responsible for providing complete, truthful, and accurate information regarding your health, including, as applicable:
symptoms;
medical conditions;
medications;
allergies;
pregnancy status;
prior diagnoses;
laboratory results;
medical history; and
other information requested by your healthcare provider.
Incomplete or inaccurate information may affect the safety, appropriateness, or effectiveness of your care.
Healthcare decisions necessarily depend in part upon the information available to the treating provider.
7. Patient Responsibilities
When receiving services from CALL A PCP, you agree to:
provide accurate and complete information;
keep your contact information current;
disclose your physical location when requested;
participate from a reasonably private setting when possible;
maintain suitable telephone, internet, audio, or video access when required;
ask questions when you do not understand your treatment plan;
follow recommended follow-up instructions;
obtain laboratory testing, imaging, specialist care, or in-person evaluation when advised; and
seek emergency medical attention when instructed or when circumstances warrant.
8. Prescriptions
All prescribing decisions are made solely in the professional judgment of the treating healthcare provider and in accordance with applicable law and professional standards.
Scheduling or completing a consultation does not guarantee that any medication will be prescribed, refilled, changed, or continued.
A provider may decline to prescribe or refill a medication or may require additional information, laboratory testing, medical records, an in-person examination, specialist evaluation, or other appropriate assessment.
When medically appropriate and legally permitted, prescriptions may be transmitted electronically to the patient's selected pharmacy.
CALL A PCP does not guarantee that any pharmacy will stock, dispense, or obtain insurance coverage for a prescribed medication.
9. Laboratory and Diagnostic Testing
Requests for laboratory or diagnostic testing are subject to medical review.
Submitting a laboratory request does not guarantee that a requested test will be ordered.
A healthcare provider may approve, modify, decline, or recommend alternative testing based on clinical judgment.
Additional evaluation, a telemedicine visit, an in-person examination, medical records, or specialist referral may be required before or after testing.
Laboratory, imaging, pharmacy, and other third-party charges may be billed separately unless expressly stated otherwise.
10. Follow-Up and Continuity of Care
Patients are responsible for completing recommended follow-up.
Depending upon the patient's condition, CALL A PCP may recommend or require ongoing primary care, preventive services, laboratory testing, diagnostic testing, imaging, vaccination, specialist consultation, urgent care, emergency care, or an in-person medical examination.
CALL A PCP's telemedicine services are not intended to replace emergency care or any in-person care that a healthcare provider determines is medically necessary.
11. Fees and Payment
CALL A PCP is primarily a self-pay medical practice unless otherwise expressly stated.
Fees for services are disclosed through the applicable scheduling, checkout, patient portal, or payment process.
Payment requirements, cancellations, refunds, missed appointments, and other financial matters are governed by the separate CALL A PCP Financial Policy in effect at the time of service.
Laboratories, pharmacies, imaging facilities, specialists, and other third parties may charge separately for their products or services.
CALL A PCP does not guarantee reimbursement from any health plan, health savings account, flexible spending account, or other third party.
Prices may change from time to time.
12. Appointment Cancellations and Missed Appointments
Cancellation, rescheduling, late-arrival, missed-appointment, refund, and related policies are governed by the current CALL A PCP Financial Policy and any terms disclosed when the appointment is scheduled.
13. Privacy and Protected Health Information
CALL A PCP is committed to protecting patient privacy.
The use and disclosure of Protected Health Information (“PHI”) is governed by applicable federal and California law and, where applicable, by CALL A PCP's Notice of Privacy Practices.
The Notice of Privacy Practices describes patients' rights regarding PHI and CALL A PCP's responsibilities concerning the use and disclosure of PHI.
The Website Privacy Policy separately explains how information collected through the public Website may be collected, used, and disclosed.
These Terms of Use do not replace the Notice of Privacy Practices or Privacy Policy.
14. Electronic Communications
CALL A PCP may use electronic communications for healthcare and administrative purposes, including:
appointment confirmations and reminders;
patient portal notifications;
scheduling communications;
billing communications;
prescription-related notifications;
laboratory or diagnostic notifications; and
other communications related to your care or account.
Because ordinary email and text messaging may have privacy or security limitations, patients should use the secure patient portal when instructed to do so for sensitive medical information.
Your preferences regarding optional or marketing communications will be handled in accordance with applicable law.
15. Website Content and Medical Disclaimer
Information available on the public Website is provided for general educational and informational purposes.

does not establish a physician-patient relationship;

16. Intellectual Property
Unless otherwise indicated, Website content, including text, graphics, logos, icons, photographs, videos, downloadable materials, and design elements, is owned by CALL A PCP or used with permission and is protected by applicable intellectual property laws.
You may access Website content for your personal, noncommercial use.
You may not reproduce, distribute, modify, republish, exploit, or commercially use Website content without permission except as otherwise permitted by law.
17. Acceptable Use
You agree not to:
use the Website for unlawful purposes;
provide false or misleading information;
impersonate another individual;
interfere with Website security or functionality;
attempt unauthorized access to systems or accounts;
introduce malware or harmful software;
scrape or collect information through unauthorized automated means; or

18. Third-Party Services
CALL A PCP may use or provide access to third-party services, including:
patient portal or electronic health record platforms;
telemedicine technology providers;
laboratories;
pharmacies;
imaging facilities;
payment processors; and
other healthcare or technology providers.
Third parties may have their own terms, privacy policies, and practices.
CALL A PCP is not responsible for a third party's independent acts or omissions except to the extent responsibility cannot legally be disclaimed.
19. Disclaimer of Warranties
To the extent permitted by applicable law, the public Website and non-clinical Website functionality are provided on an “AS IS” and “AS AVAILABLE” basis.
CALL A PCP does not warrant that the Website will be uninterrupted, error-free, or continuously available.
Nothing in these Terms constitutes a guarantee regarding diagnosis, treatment, prescription, laboratory result, clinical outcome, or other healthcare result.
Nothing in this Section limits any duty or responsibility that cannot lawfully be waived or limited in connection with professional healthcare services.
20. Limitation of Liability
To the fullest extent permitted by applicable law, CALL A PCP shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the public Website.
Nothing in these Terms waives, limits, or disclaims liability to the extent such liability cannot legally be waived or limited under applicable law, including duties arising from the provision of professional healthcare services.
21. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless CALL A PCP and its affiliates, officers, employees, contractors, and agents from third-party claims arising from your unlawful misuse of the Website, intentional submission of fraudulent information, or material violation of these Terms.
This provision does not require a patient to indemnify CALL A PCP for CALL A PCP's own professional negligence or other liability that cannot lawfully be shifted to the patient.
22. Changes to These Terms
CALL A PCP may revise these Terms from time to time.
The current version will be posted on the Website with its effective or updated date.
Changes will apply prospectively to Website use after they become effective, except as otherwise required by law.
Separate clinical agreements or policies will be updated according to their own terms and applicable legal requirements.
23. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law applies.
Any dispute relating solely to these Terms or use of the Website will be addressed in a court of competent jurisdiction as permitted by applicable law.
Nothing in this provision overrides any rights, venue requirements, or procedures that cannot lawfully be waived.
24. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

These Terms govern use of the Website and related online services.

If a provision in these Terms conflicts with a more specific patient agreement or clinical policy concerning the same subject, the more specific document will govern that subject to the extent permitted by applicable law.
26. Entire Agreement Regarding Website Use
These Terms, together with the policies expressly incorporated by reference, constitute the agreement between you and CALL A PCP regarding use of the Website.
They do not replace the medical record, individualized treatment plan, informed consent, or other clinical documentation applicable to your medical care.
